Although FindPetBoarding attempts to maintain the accuracy of the information on the site, we make no guarantees as to its correctness, completeness, or accuracy. Your use of any of the listed businesses' services, information or material on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any, services or information available through this website meet your specific requirements.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, all listing information, text, design, layout, look, appearance and graphics.

All the copyright and other intellectual property rights in our website and the material contained on our website are reserved.

Acceptable Use

You must not:

Use our website in any way or take any action that causes or may cause damage to the website or impair its performance, availability or accessibility;
Use our website in any way that is unlawful, fraudulent, or in connection with any unlawful, illegal, fraudulent or harmful activity or purpose;
Systematically copy content from our website with a view to creating or compiling any form of comprehensive collection, compilation, directory or database;
Republish material from our website;
Sell, rent or sub-licence material from our website;
Exploit material from our website for a commercial purpose;
Redistribute material from our website;

You must ensure that all the information you supply to us through or in relation to our website is accurate, current, complete and non-misleading.

Accounts

To be eligible for an account on our website you must:

Be resident or situated in the United Kingdom;
Be at least 18 years of age;
Own or operate a pet care business that provides services falling within the categories we offer listings in;
Have a current license issued by your local authority if one is required for carrying on the service you provide.

We may suspend your account, cancel your account or edit your account details at any time at our sole discretion without notice or explanation.

Submitting a Listing

We welcome submissions to the directory published on our website.

Each submission must be a listing in respect of pet care provision, including boarding catteries, boarding kennels, dog home boarding, dog day care or small animal boarding.

Listings must be placed into the appropriate category and we reserve the right to change your listing's category should we deem another category to be more appropriate.

We may make minor edits to your listing without prior consultation, for example correcting typos or address formatting.

For the avoidance of doubt, your submission constitutes "your content" for the purposes of section titled 'Your Content'.

Basic (Free) Listings

Basic listings will remain published on our website indefinitely subject to termination or deletion in accordance with these terms and conditions.

We may delete a basic listing at any time, with or without notice to you.

Enhanced (Paid) Listings

Enhanced listings will remain published on our website for the specified advertising period (most commonly one year), subject to termination or deletion in accordance with these terms and conditions.

You will be sent a renewal notice via email prior to your enhanced listing expiring. If you do not make payment your listing will be downgraded to a basic listing.

We may delete an enhanced listing at any time, with or without notice to you, providing that, if you have not breached these terms and condition, if we delete before the end of the period in respect of which fees have been paid we will refund you pro rata amount of those fees reflecting the advertising period remaining.

Listing Fees

If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within 14 days following the date of our written request:

An amount equal to the amount of the charge-back;
All third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);
Our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this section (including without limitation legal fees and debt collection fees).

Failing to recognise or remember the source of an entry on your card or other financial statement and making a charge-back as a result will constitute an unjustified chargeback for the purpose of this section.

Boarding Licences

The Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018 and Animal Boarding Establishment Act 1963 (Wales and Scotland) require those carrying on a business providing accommodation for other people's cats and dogs obtain a licence from their local authority. This includes those operating from private dwellings. Boarders submitting a listing on FindPetBoarding must comply with this act and any other applicable regulations that apply in their area. Please note we do not accept listings from those operating under the HMRC trading income allowance exception as we have no way to monitor income.

If you have a listing for a service that requires a licence you may upload your licence certificate in the account area or send it to us via email for verification. We may also verify your licence status by referring to information provided by, or enquiries made to, your local authority.

We indicate boarders whose licences we have verified using a green checkmark. A lack of checkmark should not be construed as a lack of licence. Licence information is provided as a guide only. Although FindPetBoarding attempts to maintain the accuracy of the licence information on the site, we make no guarantees as to its correctness, completeness, or accuracy. Licences may be revoked or surrendered at any time and pet owners should always ask to see the original licence or contact their licensing authority to confirm a licence status.

If you are found to be operating without the appropriate licence your account will be disabled and your listing removed. You will not be eligible for a refund on any listing fees paid. However, should you apply for a licence and provide evidence one has been granted within one year of the account being disabled, your account will be reactivated and the days that were remaining on the listing at the time of removal will be reinstated.

Your Content

In these terms and conditions "your content" means all works and materials (including without limitation text, images, audio material, video material, audio-visual material and files) that you submit to us or our website or otherwise ask us to include on our website for storage or publication on, processing by or transmission via, our website.

You grant us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content on and in relation to the website and any successor website or on other forms of media (existing or future). This includes across social media including Facebook, Twitter, Pinterest, and similar sites.

Any content you submit must not:

be known by you to be false, inaccurate or misleading;
be, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or harassing to any individual, merchant, partnership or corporation;
infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
violate any law, statute, ordinance or regulation;

By submitting content you represent and warrant:

the information you submit is accurate and truthful;
you will keep this information accurate and up-to-date;
you are the author of that content or that you have acquired all of the appropriate rights and / or permissions to submit it.

You may edit your content to the extent permitted using the editing functionality made available on our website.

Our use of your content is at our sole discretion and we may delete, unpublish or edit any or all of your content without notice.

Cancellation

If you no longer offer services in the categories you placed listing(s) in you agree to remove your listing(s), or contact is to notify us of this so we may remove them for you.

You may cancel your listing at any time by sending an email to admin@findpetboarding.com or selecting the option in your user account. Please note that if you cancel your listing, we do not have an obligation to delete or return to you any content you have posted to the site.

If you contact us at: admin@findpetboarding.com to cancel your listing within 14 days of making a payment we will refund your payment in full.

If you cancel after this period no refund will be provided, however if you have listings in multiple categories on request we can credit the payment from one category to another or move your listings between categories.

Termination

We may at any time, at our sole discretion and without liability to you, without cause or prior notice, terminate or deactivate your account and listing(s).

Some examples, without limitation, of why we may terminate an account are:

You are operating without a required boarding licence
We are unable to contact you on the contact details you provided
You have received one or more negative reviews
We are concerned about animal welfare

If we terminate or deactivate your account as a result of a breach of these terms and conditions you will not be entitled to any refund.

If we terminate or deactivate a listing you have paid for and you have not breached these terms and conditions we will refund you a pro rata amount of your listing fees reflecting the advertising period remaining.

Please note that if your listing is terminated, we do not have an obligation to delete or return to you any content you have posted to the site.

Links to Other Websites

Our website contains links to other websites including, but not limited to, those of listed businesses. We assume no responsibility for the content of such websites or liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another website does not imply any endorsement.

Reviews

We may include user-generated ratings and reviews on listings. The terms & conditions for submission of reviews are available here: Review Terms & Conditions

If you believe a review left for your service breaches our terms and conditions you notify us promptly via email or using the report option within your user account. If you want to take action against a reviewer because you believe their statement amounts to defamation, and you do not have their contact information you must send us a Notification of Complaint, as set out in The Defamation (Operators of Website) Regulations 2013.

We are not responsible for, or have any obligation to remove, monitor or modify, ratings or reviews.

We exclude all liability (including for negligence) to you or anyone else in respect to any loss or damage (including special, indirect or consequential loss or damage) arising out of or in connection with ratings and reviews.

Indemnity

You hereby indemnify us, and undertake to keep us indemnified, against any and all losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) due to or arising out of content you submit, or make available through the website, your use of the website, your connection to the website, reviews associated with your listing, your violation of the Terms and Conditions, or your violation of any rights of another.

Severability

These terms and conditions, along with our privacy policy and review terms and conditions, make up the whole agreement between you and us in how you use the website. If a court decides that a condition is not valid, the rest of the conditions will still apply.

Law & Jurisdiction

These terms and conditions shall be governed by and construed in accordance with English law.

Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Availability of the Website and Modifications

FindPetBoarding accepts no liability for any disruption or non-availability of the Website. FindPetBoarding reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, the services available. These Terms and Conditions shall continue to apply to any modified version of the website unless it is expressly stated otherwise.
